  1. Acceptance of Terms

    By accessing or using the On My Way application or website, you agree to abide by these Terms and Conditions.

    By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to OMW Technologies.

    OMW Technologies is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

  2. Scope of Services

    On My Way connects users who wish to send packages with independent contractors (drivers) who offer delivery services using various types of vehicles (e.g., car, motorcycle, bicycle).

  3. User Eligibility

    • For Senders: You must be at least 18 years of age to use the On My Way platform.
    • For Drivers: You must have a valid driver’s license, a commercial vehicle license plate, and provide accurate information about your vehicle.
  4. Independent Contractors

    All drivers on On My Way are independent contractors and not employees, agents, or representatives of On My Way. Drivers are solely responsible for the safety, conduct, and quality of the delivery services provided.

  5. Liability Disclaimer

    • Loss or Damage of Goods: On My Way is not liable for any loss, theft, or damage of goods during transport. Users agree to use On My Way at their own risk, and any compensation or claim for lost or damaged items is to be settled directly with the driver.

    • Vehicle and Delivery Delays: On My Way is not responsible for any delays, missed deliveries, or failure of service arising from any circumstances, including but not limited to traffic, weather, or vehicle issues.

  6. Prohibited Items

    Users are prohibited from sending items classified as illegal, hazardous, or restricted, including:

    • Firearms, explosives, and other dangerous goods.
    • Controlled substances and illegal drugs.
    • Perishable goods without appropriate packaging.
    • Any item that is otherwise prohibited by local or federal laws.

    On My Way reserves the right to deny service if any prohibited item is detected.

  7. Driver Requirements and Conduct

    • License and Insurance: Drivers are responsible for holding a valid driver’s license, commercial vehicle registration, and any required insurance.

    • Professional Conduct: Drivers must conduct themselves responsibly, respectfully, and lawfully at all times when using On My Way to conduct business.

    • Compliance with Local Laws: Drivers must comply with all applicable laws, regulations, and standards governing commercial delivery services in their jurisdiction.

    On My Way technologies will not be liable for the behavior and conduct of drivers.

  8. User Responsibilities

    • Accurate Information: Users must provide accurate and complete information about pickup and delivery details.

    • Timely Availability: Users must be available at the scheduled pickup and drop-off times and locations or communicate any changes promptly.

    • Respectful Conduct: Users must treat drivers respectfully and avoid engaging in any unlawful or inappropriate behavior.

    On My Way will not be liable for misuse of the application by users.

  9. Payment and Fees

    Pricing Structure: Delivery fees are calculated based on distance, vehicle type, and other relevant factors. Fees will be presented transparently at the time of booking.

  10. Cancellation Policy

    • Users may cancel a delivery request at any time before the driver has begun the delivery. A cancellation fee may apply if a driver has already arrived at the pickup location.

    • Drivers also reserve the right to cancel a delivery under certain conditions, such as unsafe conditions or detection of prohibited items.

  11. Limitation of Liability

    • No Liability for Third-Party Conduct: On My Way is not liable for the actions, omissions, or errors of drivers, including but not limited to property damage, personal injury, or theft.

    • Indirect Damages: On My Way shall not be liable for any indirect, consequential, punitive, or incidental damages arising from or related to the use of On My Way, even if advised of the possibility of such damages.

  12. User Data and Privacy

    For information on how we collect, use, and disclose personal information, please refer to our [Privacy Policy].

  13. Intellectual Property

    All content on On My Way, including but not limited to logos, trademarks, text, and graphics, are the intellectual property of On My Way and are protected by copyright law.

  14. Modification of Terms

    On My Way reserves the right to modify these Terms and Conditions at any time without prior notice. Users are encouraged to review the terms periodically.

  15. Governing Law

    These Terms and Conditions shall be governed by the laws of Ethiopia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Ethiopia.
